Terms of Use for the EPTEX Online Platform, dated 15 July 2026
EPTEX GmbH operates an online platform for professional users from the event industry under the name EPTEX.COM.
The purpose of the platform is to bring together supply and demand in the field of professional event technology, without EPTEX itself becoming a party to any rental, purchase, sale, or other contractual relationships that may be concluded between Users.
A key objective of EPTEX is to map technical equipment and products from the professional event industry as comprehensively and systematically as possible, including product data.
For this purpose, EPTEX provides a structured digital environment in which Users can retrieve, compare, and use information. Users can offer their own event technology to other Users for rent or sale, or indicate that they need to rent or purchase specific event technology. The transaction concluded between the Users may be carried out manually or supported by functions provided by EPTEX (e.g., automated booking processes), without EPTEX thereby becoming a party to the contract.
In addition, EPTEX provides functions designed to help Users structure information, find products and alternatives, simplify processes, and prepare decisions relating to event technology more efficiently.
EPTEX points out that a substantial part of the product data, technical specifications, descriptions, categorizations, and assignments available on the platform is collected, created, supplemented, or processed using automated processes, including artificial intelligence. Despite careful efforts, individual data may therefore be incomplete, outdated, inaccurate, or erroneous.
The information provided serves for orientation, research, preliminary selection, and process support purposes. It does not replace the User's own independent technical, commercial, legal, or safety-related review.
A. About These Terms
The terms on this page (the “Terms of Use”) form part of our contract with you. By agreeing to our terms, you agree to the entire content of this document. If you do not agree with any of these terms and conditions, please do not use our platform.
B. General Use of the Platform
B1. DEFINITIONS
Some of the terms used in this document have a specific meaning, which you will find below.
• Mapping refers, in the EPTEX context, to the process of matching a User's products to the corresponding structured data sets on the EPTEX platform. The purpose of mapping is to link the Users' differing names, spellings, and data structures to EPTEX's standardized product, brand, and category data, so that this information becomes comparable, searchable, and usable on the platform.
• Users of the platform are all persons or businesses registered on the EPTEX platform.
• Providers are Users who indicate to other Users that those Users may submit an offer to conclude a contract for the rental or purchase of event equipment.
• Seekers are Users who indicate to other Users that those Users may submit an offer to them to purchase or rent event technology.
• Service Providers are all persons or companies that provide services to the event industry. These include, in particular, providers of event technology as well as providers of ancillary services, such as insurance, vehicle rental, or the provision of personnel.
• “Event Technology” refers to equipment and accessories used in the events sector. Alternative terms include, for example, equipment, assets, event tech, etc. The term also covers products such as curtains, films/foils, scaffolding, tents, and the like.
B2. ABOUT THESE TERMS AND CONDITIONS
1. By registering on our platform, you accept these terms and any other terms specified during the course of use. These Terms of Use govern the use of the EPTEX online platform operated by EPTEX GmbH, Hamburg.
2. The platform is intended exclusively for entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law, or special funds under public law. Consumers within the meaning of Section 13 BGB are excluded from use. The operator reserves the right to request proof of entrepreneurial status (e.g., by way of a VAT ID or trade registration) prior to or during the term of the contract.
3. Should any authority or court determine that any of these terms and conditions are unlawful, the remaining terms and conditions shall continue to apply.
4. The German version of these terms and conditions is the original. In the event of a dispute concerning these terms and conditions, or a discrepancy between the German-language terms and conditions and a version in another language, the German terms and conditions shall prevail, unless local law provides otherwise.
B3. ABOUT EPTEX
1. EPTEX provides an internet-based platform,
• through which Users can identify whether, and from which other User, specific equipment may generally be available for rent or purchase,
• through which Providers can indicate that they wish to rent out or sell technical equipment, and invite other Users to submit an offer to the Provider to conclude a contract for the rental or purchase thereof, and
• through which Users can indicate to Providers that they need to rent or acquire equipment, and invite Providers to submit an offer to them to conclude a rental or purchase contract for event equipment.
The operator of EPTEX provides the technical infrastructure and technical descriptions of products from the event technology sector. When you use the platform, EPTEX provides the platform and assumes responsibility for it – but not for the information on the platform itself, regardless of whether it was created by EPTEX or by Users. EPTEX is not liable for errors in the presentation of information, nor for any consequential damages arising therefrom (see also B10). The operator of EPTEX does not become a party to the contracts concluded between Users (see B3.6).
2. Use of the platform is free of charge; however, the operator of EPTEX may make certain services subject to a fee with the User's consent. Use of the platform requires registration. The User is obligated to:
• provide truthful information when registering,
• keep their access credentials confidential, and
• not disclose their access credentials to third parties.
The User is liable for all activities carried out through their user account. The operator of EPTEX is entitled to refuse a registration without giving reasons.
3. The User undertakes to:
• use the platform only within the framework of applicable law,
• not post any unlawful content,
• not infringe any third-party rights, and
• not carry out any technical manipulations.
In particular, the following are prohibited:
• fraud,
• misrepresentation of identity,
• publication of unlawful content, and
• automated data extraction (scraping; see also B7.3 et seq.).
4. The operator of EPTEX is entitled to block user accounts or delete content, in particular but not limited to cases where
• these Terms of Use or applicable laws are violated, or
• the platform is being misused.
The User may terminate their account at any time. The operator of EPTEX may terminate the usage relationship by ordinary notice, subject to a notice period of seven days. The right to extraordinary termination for good cause remains unaffected. Any change to the shareholder structure, a change of legal form, or a transfer of the platform to another company does not require the consent of Users.
5. EPTEX may exclude Users from use of the platform, in whole or in part, at any time. With respect to the unauthorized use of automated means or automated assistants (see B7.3 et seq.), you acknowledge and agree that monetary damages are not an adequate remedy, that such unauthorized use may cause irreparable harm to EPTEX, and that EPTEX is entitled to injunctive relief to prohibit such unauthorized use.
6. Under no circumstances and in no respect does EPTEX become a party to the terms and conditions or other legal transactions between you and the provider of a sub-rental or sale; this also applies where EPTEX supports the conclusion of the contract through technical functions (e.g., automated booking processes). EPTEX is neither an agent, nor a broker, nor a contracting party; pre-contractual obligations rest exclusively with the Provider. The Provider is solely responsible for the content.
7. The User shall indemnify the operator of EPTEX against all third-party claims arising from
• unlawful content, or
• unlawful use of the platform
by the User.
8. EPTEX may name the company names of registered Users in its marketing materials.
B4. OUR PLATFORM
1. At its own discretion, EPTEX provides descriptions and labels on the platform for equipment, accessories, and other products required for events. EPTEX obtains information from Service Providers, and we cannot guarantee that everything is correct – but in providing our platform, we act with reasonable care and professional diligence. A substantial part of the product data, technical specifications, descriptions, categorizations, and assignments is collected, created, supplemented, or processed using automated processes, including artificial intelligence; despite careful efforts, individual data may therefore be incomplete, outdated, inaccurate, or erroneous. The information provided serves for orientation, research, preliminary selection, and process support purposes and does not replace the User's own independent technical, commercial, legal, or safety-related review, in particular before concluding a contract with another User. Users may obtain this data via the platform and further process it in their own IT systems if there is a corresponding agreement with the operator of the platform (e.g., an API usage agreement, etc.). It is not currently possible to obtain images. Prices are not currently displayed publicly on the platform; EPTEX reserves the right to introduce a price display or other price-related functions at a later date.
2. Users may map the product data of the equipment they hold to EPTEX's products. If products are not yet available, Users can easily request that the relevant products be added.
To the extent that Users provide product data, descriptions, technical specifications, photos, or other content on the platform as part of the mapping process or otherwise, they grant EPTEX a simple, sub-licensable right, unlimited in time, territory, and scope, to store, reproduce, and edit such content, to link it with other data, to structure and enrich it using automated processes (including artificial intelligence), and to use it on the platform and for other purposes relating to the operation, further development, and marketing of EPTEX. EPTEX may permanently store and continue to use the structured and enriched data sets arising from this, irrespective of whether the usage relationship with the relevant User continues. The same applies to photos uploaded by the User, provided the User is entitled to do so.
3. The usage relationship ends upon termination pursuant to B3.4 or exclusion pursuant to B3.5. Upon termination of the usage relationship, the User's access to the platform ends; the User has no right to the export, return, or deletion of data it has submitted or that has arisen through mapping, unless mandatory law provides otherwise or this has been separately agreed in writing. EPTEX is entitled to continue to store and use the relevant data within the scope of the rights granted under B4.2 and any statutory retention obligations. Personal data will be deleted or anonymized in accordance with the Privacy Policy (see B5) as soon as it is no longer required for the purposes stated therein.
4. The operator of EPTEX endeavors to ensure the platform is available with as few interruptions as possible. However, continuous and uninterrupted availability is not owed. The operator of EPTEX is entitled at any time to restrict the platform
• for maintenance purposes,
• for technical development, or
• for security reasons,
on a temporary basis.
5. Our platform does not constitute a recommendation or endorsement of any Service Provider or its products, services, facilities, vehicles, etc.
6. EPTEX is entitled to display advertising to the User. EPTEX is permitted to send emails to all Users, which may also contain advertising.
7. EPTEX does not become a party to the contracts concluded between Users, including in connection with the use of the platform (see B3.6).
8. Unless otherwise stated, you must be at least 18 years old to use the platform.
B5. DATA PROTECTION AND COOKIES
1. Even as a B2B platform, EPTEX processes personal data, in particular contact details (e.g., names and email addresses) of the individuals acting on behalf of the User. When using our platform, please read our Privacy Policy for further information on data protection, cookies, contacting you, and the processing of personal data.
B6. ACCESSIBILITY
1. This portal is offered exclusively to entrepreneurs within the meaning of Section 14 BGB, legal entities under public law, or special funds under public law; use by consumers within the meaning of Section 13 BGB is excluded (see B2.2).
2. The portal is provided in its current form as made available by the operator (“as is”). Unless expressly agreed in writing in an individual contract, the Provider does not owe compliance with any accessibility standards (such as the German Accessibility Strengthening Act (BFSG), WCAG, or BITV). Compatibility with assistive technologies (e.g., screen readers, specialized keyboard controls, or Braille displays) is neither owed nor guaranteed.
3. As an entrepreneur, the User is solely responsible for ensuring that the employees it deploys to use the portal have the necessary hardware and software. Limitations in use by the User's employees resulting from a lack of accessibility of the portal do not constitute a defect in performance.
B7. INTELLECTUAL PROPERTY RIGHTS
1. Unless stated otherwise, all rights to our platform (technology, look and feel, etc.) belong to the operator of EPTEX, and by using our platform you agree to use it solely for its intended purpose and in compliance with these terms.
2. Rights to the images are held by EPTEX or third parties. The following provisions apply in this regard:
• All images, photographs, graphics, files, and illustrations made available within the portal (collectively, “Images”) are protected by copyright. Third parties (e.g., photographers, image agencies, or manufacturers) hold rights in these Images.
• The operator grants the User a simple, non-transferable, non-sublicensable right, limited to the term of this contract, to use the Images solely for on-screen visual display within the portal.
• Any use beyond this is prohibited. In particular, the User is prohibited from downloading, permanently storing, reproducing, editing, distributing, or using the Images outside the portal (e.g., on the User's own websites, in online shops, or on social media channels).
• Copyright notices, digital watermarks, trademarks, or other rights notices of third-party rights holders may not be removed, altered, or obscured by the User.
• The User shall be fully liable for any copyright infringements or breaches of contract caused by the User or by persons registered through its accounts (e.g., employees).
• The User shall indemnify the operator against all third-party claims (in particular claims for damages and cease-and-desist costs of rights holders) arising from a use of the Images by the User in breach of contract. The indemnification also covers reasonable costs of legal defense.
• If there is a reasonable suspicion of an infringement of third-party image rights, the operator is entitled to block the User's access to the portal, in whole or in part, with immediate effect.
3. Regardless of whether you pursue commercial purposes or not, you are not permitted, without the prior express written permission of EPTEX, to use robots, spiders, scrapers, or other automated means or automated assistants (in particular those based on interaction with, or other use of, your browser, such as AI-powered assistants) to access, monitor, copy, scrape/crawl, download, reproduce, or otherwise use content on our platform. This applies regardless of whether commercial purposes are thereby pursued.
4. We closely monitor every visit to our platform and block anyone (and any automated system) that we suspect of:
• carrying out an unreasonable number of searches,
• using a device or software to collect technical data, availability information, registered Providers, or other information,
• doing anything that places an unreasonable burden on our platform,
• using automated assistants (including AI-powered assistants) to access the platform without express permission (see B7.3).
5. By uploading a review/image to our platform, you confirm that:
• it does not contain any viruses,
• you are permitted to share the image with us,
• you own all intellectual property rights contained in it (or are permitted to use it),
• we may use it on our platform and for all other commercial purposes (including marketing and advertising) in all media worldwide – unless you ask us to stop using it,
• it does not infringe the data protection rights of other persons, and
• you assume full responsibility for any legal claims against EPTEX relating to the image.
6. For the avoidance of doubt: we are neither responsible nor liable for any images uploaded to our platform. We may remove any image at our own discretion (for example, if we find that the image does not meet our criteria).
B8. WHAT TO DO IF SOMETHING GOES WRONG
EPTEX always endeavors to resolve any disagreements with Users directly and amicably. As the platform is intended exclusively for entrepreneurs (see B2.2), EPTEX is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body, unless and to the extent mandatory law provides otherwise.
B9. COMMUNICATION WITH PROVIDERS AND SEEKERS
We may assist you in communicating with other Users, Providers, and Seekers, but this does not mean that we assume responsibility for the content, or for anything that the User/Provider/Seeker does or fails to do. We cannot guarantee that they will read anything from you or that they will do what you request. The mere fact that you contact them, or that they contact you, does not mean that you have grounds to take legal action.
B10. LIMITATION OF LIABILITY
1. EPTEX shall be liable without limitation for damages resulting from injury to life, body, or health, for damages arising from the assumption of a guarantee or a contractual assurance as to specific characteristics, and for damages resulting from an intentional or grossly negligent breach of duty by EPTEX, its legal representatives, or vicarious agents.
2. In all other respects, EPTEX shall be liable only for breaches of material contractual obligations (cardinal obligations), i.e., obligations the fulfillment of which is essential to the proper performance of the contract in the first place and on the observance of which the User may regularly rely. In such cases, EPTEX's liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded, but in any event to a maximum of EUR 100,000.00 per event of damage, and to a maximum of EUR 250,000.00 in total per calendar year.
3. Any further liability of EPTEX is excluded. The above limitations of liability also apply for the benefit of the legal representatives and vicarious agents of EPTEX where claims are asserted directly against them. Users, Service Providers, or Providers are not vicarious agents of EPTEX; EPTEX is therefore not liable for damages caused by, or attributable to, Users, Service Providers, or Providers.
4. To the extent legally permissible, the User's claims arising from the liability governed in this Section B10 shall become time-barred within one year of the statutory commencement of the limitation period. This does not apply to claims under Section B10.1.
5. EPTEX makes no promises regarding the products and services of Users, Providers, or Service Providers (unless expressly stated otherwise in these terms and conditions). Selecting the right Provider is entirely your responsibility; this applies in particular to reviewing product data that was created or enriched using automated processes (see B4.1).
B11. GOVERNING LAW AND JURISDICTION
1. These terms are governed by the law of the Federal Republic of Germany.
2. If the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Hamburg (legal basis: Section 38 of the German Code of Civil Procedure (ZPO)).
B12. AMENDMENT CLAUSE
1. EPTEX is entitled to amend these Terms of Use at any time, to the extent legally permissible. EPTEX will inform the User of material changes in text form before they take effect, unless the change is legally required or exclusively benefits the User. If the User does not object to a material change within 14 days of receiving the notice, the change shall be deemed accepted; EPTEX will specifically draw attention to this legal consequence in the notice.
2. If you do not agree with a change, please do not use our platform.
3. Otherwise, your continued use of our platform after the effective date of the change shall be deemed your acceptance of the revised terms and conditions.
B13. MISCELLANEOUS PROVISIONS
1. Amendments and supplements to these Terms of Use, as well as side agreements, require text form (e.g., email), unless expressly provided otherwise in these terms.
2. The User may only transfer rights and obligations arising from the usage relationship to third parties with the prior written consent of EPTEX. EPTEX is entitled to transfer rights and obligations arising from the usage relationship to a company affiliated with EPTEX or in connection with a transfer of the platform (see B3.4).
3. EPTEX shall not be liable for any failure or delay in performing its obligations to the extent this results from circumstances beyond EPTEX's reasonable control (force majeure), in particular disruptions to internet infrastructure or the energy supply, strikes, or governmental measures.
4. Users undertake to treat as confidential any knowledge of other Users' business data obtained through the platform (in particular availability and other business terms) and to use it exclusively for the intended use of the platform.
C. Sub-Rentals and Sale of Event Equipment
C1. ABOUT THIS SECTION
1. This section contains the special terms and conditions for products and services relating to the rental, hiring, sale, and purchase of equipment. It applies in the same way as Sections A and B.
2. Users may choose, within their account, to map individual items or all items of their equipment to the products in EPTEX's database, thereby indicating that they hold the relevant product in their inventory. Users are free to decide whether and which products to publish, and may change this at any time without notice.
3. As described in B3.1, Providers can indicate via EPTEX that they wish to rent out or sell event equipment.
4. As described in B3.1, Seekers can indicate via EPTEX that they need to rent or acquire equipment.
C2. CONTRACTUAL RELATIONSHIP WITH THE PROVIDER OR SEEKER
1. If you submit a request to a Provider, or, as a Provider, make an offer to a Seeker, this takes place directly between the Users involved; EPTEX does not become a party to the contract (see B3.6). Contracts are not concluded on or through the platform, but directly between the Users involved.
2. Our platform only displays event technology products from Providers registered with EPTEX. Providers decide for themselves which products to display and which not to, meaning it is not excluded that Providers hold further products in their portfolio. Providers may display all products that they hold in stock or seriously intend to acquire. The proportion of products displayed that are not held in stock may not exceed 5% of the total number of products offered. If a Provider violates this requirement, EPTEX is entitled to remove the affected listings from the platform without prior notice; in the event of repeated or serious violations, EPTEX is further entitled to exclude the Provider from use of the platform pursuant to B3.4.
3. EPTEX decides the order in which Providers' or Seekers' products are displayed.
4. If something is displayed that should not have been published, we will correct this as quickly as possible once we become aware of it. Because errors can never be entirely ruled out, Providers, Seekers, and Users should not upload to the platform any data they do not want published under any circumstances.
5. Information about Providers, Seekers, Users, and products (including availability and cancellation policies) is based on the information we receive from them. Any liability of EPTEX for such content is excluded (see B10).
